My approach to teaching and writing is not so much focused on a doctrinal understanding of the law, but rather on interrogating our basic presumptions about the law in order to illuminate the social and political arrangements that organize the content of legal rules and principles.

In that work I tried to make sense of the intuition that our practice of holding people responsible through criminal law is not fully warranted when it comes to victims of severe economic injustice. I understood this as an investigation about the ways in which the different spheres of justice should interact with each other in the need to ground the state’s authority to punish. This paper argues that the issue of authority is indeed the heart of the matter, but unlike most slfredo it argues that extreme poverty completely subverts the meaning of punishment and renders it into an instance of pure epnal. By looking into foundational ideas of punishment and legality in literary resources like The Oresteia as well as in early modern philosophical discourse, the paper argues that punishment requires a context of authority to be a part of legal and political justice, and even in a minimal account of political legitimacy such as that formulated by Hobbes, extreme poverty undermines such context.

In order to present and criticize this presumption, the article traces its origins by revisiting the debate about the nature of punishment that took place during the emergence of liberal political philosophy.

After evaluating the main arguments of this debate the article concludes by arguing that liberal theories of punishment alfredp give up this presumption.

Cambridge University Press Journal Name: Abstract Through derechoo assessment of the normative implications of economic exploitation, the article seeks to strengthen the thesis that principles of egalitarian distributive justice should apply globally. The existence of an international economic order that produces relations of exploitation demands the application of the standards of an egalitarian distributive justice for two kinds of reasons.

First, because exploitation must be justified in a similar way and for similar reasons than coercion.

Second, because the existence of exploitation implies high levels of institutional and economic cooperation and interdependence.
